Terms & Conditions
BOOKING AGREEMENT
Your reservation is secured and a formal agreement is in place once the Travel Organizer or your designated travel consultant sends a written affirmation following the collection of the necessary deposit sum. It is crucial to review your confirmation promptly to identify any errors or omissions and inform the Travel Organizer or the authorized representative without delay. Ensure that the names provided align precisely with the details in the respective passport.
To initiate a booking, you must be no younger than 18 years old. You commit to supplying the Travel Organizer with information that is both thorough and correct.
RESERVING ON BEHALF OF OTHERS
When you make reservations for other attendees, you assume the role of the appointed liaison for every individual encompassed in that reservation. This entails bearing the responsibility for fulfilling all payment obligations associated with your Tour reservation, updating the Tour Operator or your travel consultant regarding any requisite alterations or cancellations, and ensuring your group is kept abreast of necessary details.
By securing a reservation on behalf of other individuals, you affirm and guarantee that you have procured all necessary approvals. You hold the responsibility for confirming that any data you convey on behalf of another attendee is comprehensive and true. The Tour Operator will not be held accountable for any inaccuracies or overlooked details in the supplied information necessary to finalize a reservation.
NECESSARY MEDICAL DETAILS
You are obliged to share any medical details reasonably asked for by the Tour Operator, and filling out the Tour Operator’s medical information document might be necessitated.
Certain tours make completing Medical Forms compulsory. If existing medical issues might affect your capacity to travel, engage in a tour, go to far-flung areas devoid of medical amenities, or negatively influence others’ tour experiences, you are required to submit a physician-signed Medical Form to the Tour Operator either at the point of the final payment for the respective booking or before that.
You commit to sincerely and fully filling out the Medical Form, divulging all pertinent medical facts. The information will be safeguarded as per the Privacy Policy of the Tour Operator.
For your welfare or the secure management of a tour, the Tour Operator retains the prerogative to ask for additional details or expert medical assessments as deemed necessary.
The Tour Operator holds the authority to refuse your engagement in any tour segment anytime, imposing the risk and costs on you, should they judge your mental or physical state as unsuitable for travel or potentially hazardous to yourself or others.
Pregnancy falls under medical conditions and must be informed to the Tour Operator when booking. The Tour Operator can decline to accommodate pregnant individuals beyond 24 weeks or anyone with specific medical conditions if reasonable adjustments or substitutes cannot be facilitated.
Failure to fulfill the Medical Form requisites or to reasonably provide the necessary medical data for any reason by the stipulated deadline grants the Tour Operator the right to annul your booking, activating all relevant cancellation charges.
Determining the appropriateness of a tour for you is your duty. Consult with your physician to verify your health status for traveling and participating in scheduled activities. Advice on necessary vaccinations and preventative medical measures should be sought from your physician. The Tour Operator refrains from offering medical counsel. You bear the obligation to gauge the demands and risks of every tour element, considering your individual limitations, health status, and medical necessities.
Tour Operator-led travels might include stops in isolated or evolving areas, presenting difficulties in accessing medical aid and potentially subpar medical facilities compared to your home nation. The medical facility standards in the nations on your tour itinerary might differ, and the Tour Operator neither asserts nor assures the medical facilities’ accessibility or quality in those locales.
SPECIFIC NEEDS
You should inform the Tour Operator of any specific needs at the booking stage. While the Tour Operator will make a reasonable effort to cater to special needs or requests, fulfillment is not guaranteed due to the characteristics of the destinations visited and the limitations in options outside the predefined itinerary. If you have restricted mobility, you might find that certain activities are not accessible. It is essential to notify the Tour Operator of all food allergies and dietary limitations when booking, but there is no guarantee that these needs or restrictions will be met. The inability to meet any special requests or needs does not constitute a breach of the terms or the agreement between you and the Tour Operator, and the Tour Operator is not held responsible for any unfulfilled requests.
AGE REQUIREMENTS
Individuals below 18 years old at the commencement of the travel are regarded as minors. Minors are required to be in the company of an adult at all times. A single adult can accompany a maximum of two minors. Unless specified differently in the Tour details or by the Tour Operator, the lower age limit for minors participating in any Tour is 12 years.
Bookings involving minors are subject to evaluation and approval by the Tour Operator. If the law necessitates a minor to obtain permission from a parent, guardian, or any other
entity to travel, the attending adult is tasked with acquiring all requisite consents and documents, as well as ensuring legal compliances for both them and the minor(s) for traveling, and for entering and exiting the concerned countries and regions. The Tour Operator is not liable for any charges, detriments, or losses arising due to the failure in obtaining the necessary consents, authorizations, and approvals.
Each adult part of a booking involving minor(s) shares collective responsibility for the minor(s)’ conduct, safety, oversight, and supervision, and unconditionally accepts these terms on behalf of the minor(s) incorporated in their booking, inclusive of all risk acknowledgments and liability restrictions. The Tour Operator is not obligated to offer care services for minors and overtly renounces any duty of overseeing or managing any minor(s).
OBLIGATORY INSURANCE GUIDELINES
IT IS MANDATORY TO POSSESS TRAVEL INSURANCE that provides a minimum protection for medical issues, evacuation, and repatriation amounting to at least EUR€100,000, which encompasses all the travel dates arranged with the Tour Operator. The insurance should safeguard against personal accidents and encompass emergency healthcare costs. A Tour Operator’s agent will confirm the adequacy of your insurance protection on the initial day of every Tour. It is highly advised to broaden your insurance to encompass cancellation, reduction, and all other unforeseeable expenses that might occur owing to loss, damage, injury, delay, or inconvenience during your journey. You acknowledge that the Tour offerings do not comprise insurance coverage, and acquiring separate coverage entails additional expenditure. It is your duty to secure adequate coverage and adhere to the stipulations of the relevant insurance schemes. Informing your insurance provider of your travel kind, destinations, and scheduled activities in your booking to facilitate proper coverage provision falls under your responsibility.
RATES, ADDITIONAL CHARGES, AND TAXATION
The stipulated cost of the Tour and any goods or amenities provided by the Tour Operator is variable and can be altered at any point, prior to or following the confirmation of the booking, up until 30 days before the scheduled departure. The pricing outlined for Tours is devoid of any pertinent sales taxes. Subsequent to the issuance of a confirmation invoice by the Tour Operator, they retain the prerogative to levy additional charges on any booked products or services owing to escalations in transportation expenditures, fuel pricing, duties, taxation or service fees such as fees for embarking or disembarking at harbors and airports, alterations in currency and exchange rates, tax augmentations, or governmental interventions affecting the pricing of the specific products or services; albeit, this will be implemented only when the concerned rise is in excess of 2% of the initial price accorded for the products or services (excluding auxiliary options, insurance, and taxes). In the scenario where imposing a surcharge becomes imperative, the Tour Operator is committed to notifying you with reasonable promptness.
If the price surge surpasses 7% of the initial cost of the relevant products or services (excluding auxiliary options, insurance, and taxes), you are endowed with the options to either:
(a) Cancel the concerned booking devoid of any penalty imposition; or
(b) Consent to the amended price.
It is incumbent upon you to inform the Tour Operator of your decision within a 14-day period following the receipt of the increase notification; failure to do so will be perceived as an acceptance of the modified pricing, thereby making you accountable for the augmented payment.
Occasionally, the Tour Operator might introduce discounted rates for certain products or services. Such concessions are applicable solely to fresh bookings. For bookings where the Tour Operator has received at least a deposit, the benefit of reduced pricing is inapplicable.
VALIDITY
Every detail concerning dates, itineraries, and pricing of Tours is susceptible to alterations at any moment, and the prevailing cost will be stated and affirmed during the booking process, abiding by any surcharges that may be imposed according to these Terms.
You accept the obligation to remain informed about the precise particulars of your Tour and other products or services. This includes the essentiality of reviewing the Tour Operator’s website at a minimum of 72 hours before departure to be aware of minor modifications that might have been instituted post the booking period.
DEPOSITS
When securing your booking, a non-refundable deposit amount specified in various currencies, per individual for each Tour, is required by the Tour Operator. If a reservation is carried out 60 days or fewer prior to departure, the entire amount is payable during the booking process. This non-refundable deposit ought to be remitted to the Tour Operator or the designated agent, where applicable.
For bookings involving a combination of different products or services provided by the Tour Operator, a higher deposit might be demanded or even a requirement to pay the full amount at the time of booking could be imposed. The Tour Operator will notify you of such prerequisites before confirming the pertinent booking.
DETAILS REQUIRED FOR BOOKING
To finalize your booking, it’s mandatory to provide the Tour Operator with the information they request along with the final payment. Not supplying all necessary details before the full payment due date will incur an administrative fee to cover any costs the Tour Operator bears due to this. Moreover, failing to give information needed for air tickets, permits, or other inclusions makes you responsible for any consequent costs, fees, or losses, including the inability to secure or provide those inclusions.
If you don’t provide necessary information, the Tour Operator has the right to consider your booking or a part of it as cancelled, and to impose a reasonable cancellation fee at their discretion. The specific information required will be communicated to you or to the Tour Operator’s authorized agent during the booking process, and it varies depending on the Tour.
Bear in mind, any fees that arise due to mistakes, omissions, inaccuracies, or late or incomplete information you provide will be your responsibility, and the Tour Operator won’t be accountable for them.
AIRFARE
The Tour’s prices don’t include international or any other kind of airfare unless it is clearly stated in the Tour’s descriptions. While the Tour Operator can offer you a quote featuring the best available price for the travel dates you ask for, remember, this is just an estimate and not a fixed price commitment either from the Tour Operator or the relevant air carrier(s).
When it comes to air travel, the Tour Operator functions purely as a sales agent for the respective air carrier, meaning the carrier’s terms and conditions govern the purchase and utilization of the air travel ticket. To get the full picture including the cancellation policies, it’s recommended to check the air carrier’s terms and conditions as well as the conditions of carriage.
It’s important to note that the Tour Operator doesn’t hold responsibility for any changes in air itineraries or flight timings and won’t offer advice or alerts about air tickets, flight statuses, or delays. This remains your responsibility to manage and monitor.
FINAL PAYMENT & ACCEPTANCE OF BOOKING
Make sure to refer to the confirmation you receive either from the Tour Operator or your travel agent for the specifics on the final payment for your booking. Remember that the outstanding balance, which covers both the booked and bespoke services, should be settled 60 days prior to the kick-off of the first service encompassed in your booking.
In case the full payment isn’t made by the established deadline, the Tour Operator has the right to either alter the charge for the booking or regard the booking as null, holding onto the deposit as a cancellation fee. If you’re booking within a 60-day window before the start date of the initial service in your package, you’re required to pay the total amount at the time of booking.
Be aware that if any product or service has a payment schedule that’s different from what’s explained here, you’ll be informed before you book, and it will be noted on your invoice.
Lastly, any charges incurred from third parties or financial institutions during payment processing are on you. The Tour Operator won’t cover any of these fees or facilitate refunds for them.
CANCELLATION BY THE PARTICIPANT
IF you decide to cancel your booking, you’ll have to inform the Tour Operator. The fee you’ll be charged for the cancellation will depend on the exact date the Tour Operator receives your cancellation notice. This fee is calculated as a percentage of the total amount you paid for the tour, excluding any insurance products. It’s best to check specific percentages or terms with your Tour Operator to avoid any surprises. Let me know if there’s anything else you’d like to know or discuss!
CANCELLATION OF A TOUR:
WHEN you are thinking of cancelling a tour, here are the specifics regarding the refund you can expect:
– 60 days or more before departure: Your Lifetime Deposit will be retained, but the rest of your payments will be refunded.
– 59-30 days before departure: While your Lifetime Deposit stays intact, you will receive a 50% refund of the remaining payments made for the tour.
– Less than 30 days before departure: Your Lifetime Deposit will be held, but unfortunately, no other refunds will be provided.
In the case where you’ve bundled various services, different cancellation policies might apply, and the Tour Operator will let you know about this beforehand.
When it comes to cancelling additional services like Arrival Transfers, Pre and Post Night Accommodations, My Own Room, and other optional activities, here’s what happens:
– 31 days or more before departure: You get a full refund.
– 30 days or less before departure: No refund will be given.
Keep these terms in mind to make informed decisions. If you have any questions, feel free to ask.
GUARANTEED DEPARTURES & CANCELLATION POLICIES:
So, once at least one booking on a tour is secured with a deposit, that departure date becomes “guaranteed.” This means that, aside from serious changes needed due to safety or other very good reasons (but not Force Majeure situations), the tour will happen as confirmed. Just remember to always check the latest details on their website because printed materials can become outdated.
In the rare case that the Tour Operator has to cancel the tour (unless it’s because of Force Majeure or something you did), you’ve got a few options:
– Option a: Take a replacement tour that’s of equal or even higher value.
– Option b: If no tours are available that are as good or better than what you booked, you can choose a lesser value tour and get refunded the difference in cost.
– Option c: Just get all your money back.
Unfortunately, they won’t cover any other costs you might have had like non-refundable flights or vaccines, or even the excitement and time you’ve put into planning your tour.
If something major in the tour can’t happen as planned after it’s started, they’ll try their best to find a good alternative. If that isn’t possible or if you’re not happy with the option(s) they provide, they might give you a refund for the part of the tour that couldn’t be provided, although this is at their discretion.
Hope that helps clarify things! Let me know if there’s anything you’re wondering about.
TRAVEL DOCUMENTS:
Absolutely critical – you’ve got to make sure to have all the necessary documents ready and correct before the tour starts. This includes:
– A passport that’s valid for at least 6 months after your tour ends
– Any visas, permits, and certificates (like ones for vaccinations or medical clearance) needed for the places you’ll be visiting
– The right insurance policies
Unfortunately, they don’t give advice on what exactly you need, so you’ll have to figure that out yourself and bear any costs that come up if something’s missing or not right. So, do double-check everything to avoid unexpected issues and expenses.
Let me know if you’d like any tips or guidance on how to ensure you have all the necessary documents! Stay safe!
ACCEPTANCE OF RISK
You acknowledge that the services and products offered by the Tour Operator may involve a significant amount of risk to your health and safety. By traveling with the Tour Operator, you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risk and releases the Tour Operator from all claims and causes of action arising from any damages or injuries or death resulting from these inherent risks. Prior to departure, it is your responsibility to familiarize yourself with all relevant travel information including applicable health risks, local customs and entry requirements, and any other relevant laws and policies of the regions you plan to visit. The Tour Operator is not responsible for any injury, loss, or damage to person or property, death, delay, or inconvenience in connection with the provision of, or failure to provide, any goods or services occasioned by or resulting from — but not limited to — acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labour activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or any failure of any transportation mechanism to arrive or depart timely or safely.
LIMITATION OF LIABILITY
The Tour Operator contracts with a network of companies, government agencies, and individuals to assist in the running of its tours, products, and services. To the extent permitted by law, the Tour Operator is not responsible for the acts and omissions of these third parties.
To the maximum extent permitted by law, the Tour Operator disclaims liability for any damages or injuries, including but not limited to those caused by any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure.
The Tour Operator is not liable for any damages or losses that may result from travel to any particular destination. The Tour Operator does not endorse or represent the reliability, accuracy, or quality of any information, goods, services, or products displayed or advertised by others on or through the Tour Operator’s services. Reliance upon any such information, goods, services, or products shall be at the user’s risk.
The Tour Operator is not liable for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside the Tour Operator’s control.
In the event of any liability incurred by the Tour Operator, such liability shall be limited to the amount paid to the Tour Operator for the tour(s), product(s), or service(s) giving rise to such liability.
You agree to release the Tour Operator from all such liability and make all such claims only against the insurers, and not the Tour Operator.
By using the services of the Tour Operator, you waive any claim against the Tour Operator, its officers, directors, and employees for any damage to, or loss of, property, or injury to, or death of, persons due to any act or omission of others providing services, including but not limited to negligence, war, strikes, hostilities, civil disturbances, or acts of God, and agree to indemnify the Tour Operator against any and all claims, actions, demands, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable legal fees and costs) which arise out of or relate to your breach of these Terms.
OPTIONAL EXTRAS
Optional extras are any activities, tours, or arrangements you choose to buy separately from the Tour Operator’s packages and are not part of the itinerary. The term “Optional Extras” includes, but is not limited to, any activity, tour or arrangement designed to enhance your tour experience, including by way of example and not limitation: shore excursions, land tour excursions, tours or outings, rafting, kayaking, safari, helicopter tours, and other extras that are not included in the Tour Operator’s packages.
The Optional Extras are not part of the Tour and do not constitute a contract between you and the Tour Operator. Although the Tour Operator may suggest reputable operators of Optional Extras or assist you in booking such activities, the Tour Operator makes no warranty about the Optional Extras or their providers, nor does the Tour Operator offer any guarantee of their safety, quality, or fitness for any particular purpose.
You understand and accept that any assistance given by the Tour Operator’s representative in arranging, selecting, or booking, any Optional Extras is purely at your request and the Tour Operator makes no warranties and expressly disclaims any liability arising from participation in Optional Extras or any information provided by any representative of the Tour Operator regarding any Optional Extras.
You understand that your contract for any Optional Extras is with the operator of the Optional Extras and not with the Tour Operator. The Tour Operator is not responsible for any Optional Extras that you may choose to book or pay for whilst you are on tour and any Optional Extras do not form part of your contract with the Tour Operator for your Tour booking.
You acknowledge that you are responsible for making the necessary inquiries and taking necessary precautions to protect your health and physical condition before booking or participating in any Optional Extras, as well as for adhering to any laws and regulations of the country in which Optional Extras are conducted.
You expressly release the Tour Operator from any claims and causes of action arising from any damages, losses, deaths, or injuries you may suffer as a result of your participation in any Optional Extras, and agree to indemnify the Tour Operator against all claims, actions, demands, liabilities, losses, damages, costs and expenses (including legal fees and costs) which arise out of or relate to your participation in any Optional Extras. Absolutely, Optional Extras are indeed activities, meals, or services that are not clearly included in the official itinerary or the overall price of the Tour. As they are not a formal part of the Tour, the Tour Operator does not take any responsibility for these extras. In case you request assistance from the Tour Operator’s representatives in arranging or booking any Optional Extras, it’s purely a favour and not an obligation. They are not promising anything regarding the safety, quality, or suitability of these Optional Extras.
Participating in or booking Optional Extras might, unfortunately, involve some risks including, but not limited to, damages, loss of enjoyment, inconvenience, or even injuries. So, it’s essential to know that if you decide to go for any of these Optional Extras, you’re releasing the Tour Operator from all the claims arising from any issues related to these extras. You’re willingly taking responsibility for any loss, damages, or other unfortunate events that might occur while participating in these activities.
The sole entity responsible for any unfortunate event arising from Optional Extras will be the third-party provider of that service or activity, not the Tour Operator. Stay safe, Professor.
CLAIMS & COMPLAINTS
In case of any dissatisfaction with the services provided by the Tour Operator or any Third- Party Suppliers, it is your responsibility to notify the Tour Operator as promptly as possible, and ideally during the tour itself, to allow the Tour Operator a fair chance to address and rectify the issue.
In the event of a complaint, you must first inform the tour leader or another representative of the Tour Operator at the earliest opportunity, allowing them to try to rectify the issue on the ground. If the issue cannot be resolved on tour and you wish to lodge a complaint, you must submit your complaint in writing to the Tour Operator within 30 days of the tour’s end date. The complaint should be detailed, specifying the perceived failures clearly to allow the Tour Operator to effectively address the issues.
You acknowledge that failure to report your complaint in a timely manner may adversely affect the ability of the Tour Operator to investigate claims thoroughly and may impact your ability to seek redress or compensation.
The Tour Operator will not be liable for any claims made later than 30 days after the completion of your tour. Any claim brought forth against Third Party Suppliers must be directed to the Third-Party Supplier involved and not the Tour Operator.
You acknowledge and agree that the Tour Operator acts only as an intermediary between you and the Third-Party Supplier, and therefore, it will have no liability for any failures, breaches, or negligence on the part of the Third-Party Suppliers. You also agree that any claims that are approved for compensation will be resolved solely through a direct agreement between you and the Third-Party Supplier, and not the Tour Operator.
By submitting a complaint, you agree to cooperate fully with the Tour Operator and to provide any additional information and supporting documentation as requested. The Tour Operator reserves the right to reject any claims that are unreasonably delayed, unfounded, or unsupported by evidence.
To facilitate a constructive resolution of complaints, it is expected that all parties maintain a respectful and cooperative attitude throughout the complaint process. It is understood that any form of verbal or written abuse directed towards Tour Operator staff, representatives, or Third-Party Suppliers will not be tolerated and may result in immediate dismissal of your complaint.
LIABILITY
The Travel Agency and its associated entities, including parents, subsidiaries, employees, officers, directors, successors, agents, and affiliates are not to be held accountable for (A) any damage or loss of belongings, or injury to or death of individuals arising directly or indirectly from actions or failures of any other service provider, including, but not confined to flaws in any aircraft, vessel, or vehicle operated or furnished by such other providers; and (B) any loss or damages resulting from delays, cancellations, or disruptions instigated by government regulations, actions or lack thereof, demands, directives, or interventions, or by force majeure events such as acts of God, strikes, fire, flood, warfare, rebellions, terrorist acts, insurrections, illnesses, quarantines, outbreaks, theft, or other unforeseeable events outside their control. You forego any claim against the Travel Agency for such losses, damages, injuries, or death.
In cases of loss, death, injury, or illness induced by the negligence of the Travel Agency or third-party vendors involved in the booking contract, the Travel Agency circumscribes its accountability in line with all pertinent international conventions.
The transportation of passengers and their luggage over sea is dictated by the amended Athens Convention on the Carriage of Passengers and their Luggage by Sea (PAL) (the “Athens Convention”), which is overtly embodied in these terms, with any responsibility of the Travel Agency and the Carrier (as defined in the Athens Convention) for death, personal injury, or loss or damage to luggage ensuing from sea transportation solely determined in adherence with this convention. The convention restricts the Carrier’s accountability for death or personal injury and for luggage loss or damage and lays down particular provisions for valuables, presuming undamaged luggage delivery to the Guest barring written notification to the Travel Agency and/or the Carrier:
(a) for obvious damage, before or during disembarkation or re-delivery; or
(b) for latent damage or loss, within a 15-day period from disembarkation or re-delivery or from when such re-delivery should have been effected.
Any payable damages by the Travel Agency up to the extents defined in the Athens Convention will be offset by any contributory negligence on your part and by the utmost deductible cited in Article 8 (4) of the Athens Convention. Copies of the Athens Convention can be obtained from the Travel Agency upon request.
In regard to claims stemming from sea transportation, the Travel Agency retains all rights, defenses, immunities, and limitations available to the actual carrier and under relevant conventions as established in these terms. Any term here that becomes null due to the Athens Convention or other mandatory legislations, or is otherwise unenforceable, will be null to that extent but not further. The liability of the Travel Agency shall never surpass that of the carrier under its Conditions of Carriage and applicable conventions or legislations. Any liability that the Travel Agency may incur, whether under contract in accordance with these terms or otherwise, will always adhere to the Athens Convention’s liability limitations for death or personal injury.
Despite any contradictory provisions in these terms, the Travel Agency disclaims liability for any loss of profits, enjoyment, revenue, usage, contracts, opportunities, or any other secondary or indirect loss or damage of similar nature.
Regarding non-personal injury, death or illness claims or those not governed by the above- referenced conventions, the Travel Agency’s liability for supplier negligence shall be limited to the amount you paid for the relevant tour, excluding insurance premiums and administrative fees. In cases involving loss or damage to luggage and personal possessions, the Travel Agency’s liability shall not exceed €1,000 EUR. The Travel Agency is not responsible for the loss or damage of any kind of valuables. Double recovery is prohibited;
you agree not to pursue recovery for the same claims from both the Travel Agency and its suppliers, contractors, or other third parties.
FORCE MAJEURE
The Travel Agency will not bear responsibility for death, bodily harm, sickness, damage, delay, or other loss or detriment to individuals or assets, or financial costs incurred both directly and indirectly, or for the Travel Agency’s failure to initiate, execute, or fulfil any duty owed to you if such occurrences of death, delay, bodily harm (inclusive of emotional distress or injury), sickness, damage, or other losses or detriments to individuals or assets are instigated by Acts of God, warfare or situations resembling warfare, mechanical failures, terrorist acts or imminent threats of them, civil unrest, labour issues, interventions by authorities, political instabilities, irrespective of where and how these arise or are caused, riots, insurgences, governmental restrictions, fires, severe weather conditions, or any other circumstance beyond the reasonable control of the Travel Agency; or an event which the Travel Agency or a third-party service provider could not anticipate even with all due diligence, all of which, individually and collectively, represent “Force Majeure”.
IMAGES AND MARKETING
You acknowledge that during your participation in any Tour, others including fellow participants, the Travel Agency, or its representatives may capture images, photos, or videos that include you. You permit the taking of such visuals and grant a continuous, royalty-free, global, irrevocable license to the Travel Agency, along with its contractors, sub-contractors, and assignees, to use them for any purpose, including but not limited to marketing and promotional activities and creating promotional materials with or without sublicensees, in any medium existing or yet to be invented, without any further obligations or payments due to you.
PRIVACY POLICY
The Travel Agency is obligated to gather your personal details to facilitate the Tour as well as any products or services you have booked. The Travel Agency will collect, utilize, and disclose only the necessary information reasonably required to allow them and their Third- Party Suppliers to furnish the specific Tour, products, and/or services you have requested, as depicted in the Travel Agency’s Privacy Policy. By offering any personal information to the Travel Agency, you are expressing your consent to the Travel Agency’s Privacy Policy.
SEVERABILITY
In the event that any clause of these Terms is deemed to be excessively broad to the point of being unenforceable, such clause will be construed to have a breadth that is enforceable. The potential invalidity or inability to enforce any particular provision of this agreement will not impact the validity or enforceability of any other provision contained herein.
CONTRACT PARTIES & SUCCESSORS
These Terms shall benefit and bind the parties involved and their respective heirs, lawful and personal representatives, executors, estate trustees, successors, and assigns.
AMENDMENTS
The Travel Agency retains the right to update or modify these Terms at any given time. Any alterations will become effective 10 days after being uploaded on the Travel Agency’s website. The latest version of these Terms, including any amendments, can be accessed at any time on the Travel Agency’s website and will be provided to you upon written request to the Travel Agency. You are considered to have agreed to any changes to these Terms 10 days after they are posted on the Travel Agency’s website. It is recommended that you review the Terms before your travel to acquaint yourself with the most recent version.
